Malaysian Family Member Arrested in Taiwan? A Guide to Fraud Charges, Detention and Bail

Learning that a family member has been arrested overseas can leave you unsure where to turn. The uncertainty becomes even greater if visits and communication are restricted.

For Malaysian families dealing with a criminal case in Taiwan, the immediate priorities are to confirm the person’s location, obtain legal assistance and understand the reasons for any detention order.

➠Recruiters may advertise high-paying jobs, paid travel or accommodation, only to instruct recruits to collect cash or transfer money connected to fraud. Whether someone knowingly participated or was genuinely deceived must be examined through the evidence.

An arrest is not a conviction, and detention does not mean that release or a successful defense is impossible.

1. How Recruitment Offers Can Lead to Money Mule Allegations

A money mule, commonly called a 車手 in Taiwan, may withdraw cash, collect payments or deliver money to another person.

Recruitment offers may describe these tasks as:

  • Collecting documents or customer payments.

  • Handling company transactions.

  • Assisting a financial or investment business.

  • Performing simple work while travelling in Taiwan.

➠A person may believe they are carrying out legitimate instructions. However, investigators may suspect fraud or money laundering when the payments are traced to victims.

The defense should establish what the recruiter said, what work was promised and what the person knew when performing each task.

Nationality does not determine guilt. Neither does the fact that someone physically collected or transferred money. The prosecution must establish the required conduct and criminal intent.

If passports were confiscated, movement was restricted or threats were made, these circumstances should be brought to the lawyer’s attention promptly. They may require a separate assessment of coercion or exploitation.

2. Understanding Detention and Restrictions on Contact

What Does “Detention With No Visits” Mean?

The expression 羈押禁見 generally refers to detention accompanied by restrictions on visits, correspondence or other outside contact.

Detention is a procedural measure while criminal proceedings continue. It is different from serving a prison sentence following a final conviction.

Under Article 105 of Taiwan’s Code of Criminal Procedure, outside contact may be restricted where it creates relevant risks, such as escape, interference with evidence or collusion with other suspects or witnesses. The scope of the actual order must be checked. law.moj.gov.tw

▫️Are Foreign Nationals Automatically Detained?

No. A person’s foreign nationality or lack of a permanent home in Taiwan does not automatically establish every requirement for detention.

Under Article 101, a judge must assess strong suspicion of an offense, the relevant statutory grounds and whether detention is necessary. Grounds may include a fact-based risk of flight or interference with evidence. law.moj.gov.tw

Travel arrangements, accommodation, connections in Taiwan and access to other participants may be relevant. Each case requires an individual assessment.

▫️Can a Lawyer Still Visit?

Restrictions on family visits do not ordinarily prevent access to defense counsel.

Article 34 separately protects meetings and correspondence between a detained accused person and their defense lawyer, subject to legally authorized exceptions. law.moj.gov.tw

A lawyer can arrange a legal visit, discuss the allegations and identify urgent medical, language or procedural needs. Updates to relatives remain subject to confidentiality, the client’s authorization and applicable restrictions.

3. How Legal Consultant Can Assist Malaysian Families

▫️Seeking Release on Bail

Article 110 permits applications to the court for suspension of detention on bail by the accused, defense counsel and certain other legally eligible persons. law.moj.gov.tw

A useful application addresses the court’s specific concerns. It may include:

  • A verified address and suitable accommodation in Taiwan.

  • A practical plan for attending questioning and hearings.

  • Available family or local support.

  • Evidence that relevant records have already been secured.

  • Proposed reporting or other appropriate release conditions.

➠A genuine lease may help demonstrate stable accommodation. It does not automatically eliminate flight risk or other grounds for detention. Families should discuss accommodation arrangements with counsel before committing to expenses.

➠Release on bail also does not automatically permit travel back to Malaysia. Any departure restrictions and immigration requirements must be examined separately.

▫️Examining Whether the Person Was Deceived

Legal preparation may involve reviewing recruitment advertisements, complete conversations, travel records, payment instructions and financial transactions.

The key questions include:

  • What did the person believe the work involved?

  • Were legitimate business documents or explanations provided?

  • Did instructions reveal that the money came from fraud?

  • Were there threats, restrictions or attempts to seek help?

  • What happened when the person first became suspicious?

The defense should explain these facts accurately and connect them to the evidence.

▫️Preparing for the Final Case Outcome

Bail and the final judgment are separate matters.

Depending on the evidence and applicable law, counsel may seek non-prosecution, prepare an acquittal defense, challenge an aggravated charge or present sentencing mitigation.

A suspended sentence follows a conviction and is subject to statutory requirements and conditions. It should not be described as an acquittal or a guaranteed exemption from imprisonment.

Where settlement or compensation is appropriate, it should be handled lawfully and with a clear understanding of its possible effect. Settlement does not automatically end prosecution.

4. Immediate Steps for Family Members in Malaysia

1. Confirm the Location and Procedural Stage

Gather the person’s full name, passport details, arrival date and last known location. Keep copies of any police notices, court documents, detention orders or case numbers.

Clarify whether the person is being questioned, awaiting a detention hearing or already held under a court order. These stages require different responses.

2. Contact a Taiwan Criminal Defense Lawyer

Early consultation can help identify the responsible authority, arrange legal access and prepare for an upcoming hearing.

Ask for a clear explanation of the scope of representation, fees and communication arrangements. No lawyer can guarantee release by a particular date.

3. Preserve Recruitment and Financial Evidence

Keep original job advertisements, messages, flight bookings, accommodation records and payment information.

Do not delete conversations or contact suspected participants to coordinate explanations. Materials held by relatives in Malaysia may help establish the recruitment timeline.

4. Prepare Background and Medical Documents

Employment records, family information and financial documents may assist with release planning or sentencing submissions, depending on their relevance.

Also provide details of urgent medication, medical conditions or difficulty understanding Mandarin so that appropriate assistance can be requested.

5. Verify Requests for Money

Treat promises to “settle everything” through unofficial payments or personal connections with caution.

Verify any claimed legal fee, bail requirement or official instruction through counsel and the relevant authority before transferring money.

6. Agree on a Family Communication Plan

Choose a family contact to organize documents and receive authorized updates. This can reduce confusion and help the lawyer obtain consistent, accurate information.

Counsel must respect restrictions on contact and cannot be used to pass messages that interfere with the investigation.

Legal Support Across Borders💡

Legal Consultant can assist Malaysian families with lawyer visits, detention hearings, bail applications and the defense of fraud or related allegations in Taiwan.

The first consultation is more useful when the family can provide identification details, available official documents and the recruitment history.

Prompt preparation helps clarify what has happened, what remains uncertain and which legal steps are available to protect the family member’s rights.
