Age of Consent in Taiwan: Sex With Someone Under 16, Mistake of Age and Legal Defense

Sexual activity with someone under 16 can lead to criminal charges in Taiwan, even when both people agree or are in a relationship.
However, these cases require more than a simple assumption of guilt or innocence. The assessment must consider the younger person’s age at the time, the specific conduct, the accused person’s knowledge of age and whether force, abuse of authority or other circumstances were involved.
Consent does not automatically exclude liability under Article 227. Equally, an allegation must still be established through evidence.
1. Does Consent Make Sexual Activity With Someone Under 16 Legal?
Not necessarily. Article 227 of Taiwan’s Criminal Code distinguishes between people under 14 and those aged 14 or 15:
Sexual intercourse with someone under 14: three to ten years’ imprisonment.
An indecent act involving someone under 14: six months to five years’ imprisonment.
Sexual intercourse with someone aged 14 or 15: up to seven years’ imprisonment.
An indecent act involving someone aged 14 or 15: up to three years’ imprisonment. mojlaw.moj.gov.tw
A dating relationship, an invitation or apparent willingness does not automatically prevent prosecution.
For English-speaking readers, these are age-based sexual offenses, sometimes discussed using the term “statutory rape.” Their legal elements should be distinguished from offenses requiring proof of force or conduct against a person’s will.
2. What Counts as Sexual Intercourse or an Indecent Act?
Taiwan’s legal definition of sexual intercourse is broader than vaginal intercourse. Article 10 covers specified forms of sexual penetration and genital contact, including acts involving the mouth or anus and certain acts involving other body parts or objects. mojlaw.moj.gov.tw
Conduct falling outside that definition may still constitute an indecent act, depending on its nature and context.
Therefore, “we did not have intercourse” does not resolve every possible allegation. Investigators must identify the actual conduct rather than rely on a vague description such as “being intimate.”
3. Why the Younger Person’s Exact Age Matters
Article 227 applies different penalties to the two age groups. The relevant age is the person’s actual age when the conduct occurred, not their age when a complaint was filed.
Additional circumstances can change the legal assessment. If violence, threats, drugs or other methods against the person’s will were involved, forced-sexual-intercourse or aggravated offenses may require examination.
An age-based offense and an offense involving force have different elements. Neither should be assumed solely from the existence of the other.
4. Can Mistake of Age Be a Defense?
A genuine mistake about age may be relevant, but “they looked mature” is not an automatic defense.
The central question is what the accused actually knew or foresaw. This includes whether they recognized that the person might be under 16 and nevertheless accepted that possibility while proceeding.
A Ministry of Justice legal research opinion addresses this distinction: a genuine belief that the person had reached 16, without direct or conditional intent concerning the younger age, may exclude the necessary intent. Awareness of the possibility that the person was under 16 may lead to a different conclusion. This is a research opinion, not a guaranteed outcome for every case. mojlaw.moj.gov.tw
Appearance, clothing and manner of speaking may form part of the circumstances. They should be assessed alongside communications, school information, introductions and other available evidence.
5. What Evidence Matters in a Mistake-of-Age Case?
A defense should reconstruct the complete timeline rather than rely on a single statement that the accused did not know the person’s age.
Relevant questions include:
How did the two people meet? A dating app, school, workplace or introduction through friends may provide different contextual information.
Was age discussed? Messages about birthdays, school years, graduation or family life may be significant.
Was an incorrect age stated? A false age claim can be relevant, but its existence, timing and whether the accused saw it must be examined.
Were there conflicting indications? Other information may show awareness that the person was younger than claimed.
What happened after the actual age became known? Later conduct may provide context, although it cannot replace analysis of knowledge at the time.
Are the accused person’s accounts consistent? Genuine uncertainty should be explained accurately rather than filled with guesses.
A statement that someone was over 16 is evidence to assess, rather than an automatic guarantee against liability.
6. Can the Minor or Their Parents File a Complaint?
▪️Criminal Complaints
The person alleging harm may file a criminal complaint. Under Article 233 of the Code of Criminal Procedure, their legal representative also has an independent right to complain. A parent acting as the minor’s legal representative may therefore file a complaint independently. law.moj.gov.tw
However, the right to complain and the question of whether prosecution requires a complaint are separate issues.
Article 229-1 makes an Article 227 offense complaint-dependent where the alleged offender was under 18. This exception does not make every Article 227 allegation against an adult complaint-dependent. mojlaw.moj.gov.tw
▪️Withdrawal of a Complaint
For an offense requiring a complaint, withdrawal is generally possible before the close of first-instance oral arguments. A withdrawn complaint cannot be filed again.
A private settlement is not automatically a valid withdrawal, and withdrawal does not necessarily resolve independently prosecutable offenses. law.moj.gov.tw
▪️Civil Compensation
The injured person may also have a civil claim for financial loss and non-financial harm.
Parents ordinarily act as legal representatives when pursuing their minor child’s rights. They do not automatically acquire the child’s compensation claim merely because they are parents.
Any independent claim by a parent requires its own legal basis and supporting facts. law.moj.gov.tw
7. Non-Prosecution, Acquittal and Suspended Sentences Are Different
▫️Non-Prosecution
At the investigation stage, insufficient evidence of criminal responsibility may result in a non-prosecution decision.
In a mistake-of-age case, this may involve insufficient evidence that the accused knew of or accepted the possibility of the relevant age. Non-prosecution is a prosecutor’s decision, not a court acquittal.
▫️Acquittal
After prosecution, the court must assess whether the evidence proves the offense beyond reasonable doubt.
The accused does not become guilty simply because a complaint was made. Equally, citing another person’s successful mistake-of-age defense does not establish the same result in a different case.
▫️Suspended Sentence
A suspended sentence follows a conviction. It concerns whether the punishment should be executed immediately.
Article 74 generally requires a sentence of no more than two years’ imprisonment, short-term detention or a fine, together with the applicable prior-record requirements and a favorable judicial assessment. mojlaw.moj.gov.tw
Mistake of age concerns whether the offense is established. A suspended sentence concerns the consequences after guilt has been established.
8. What If Both People Are Young?
Taiwan law contains special provisions for younger offenders.
Article 227-1 provides for reduction or exemption from punishment for qualifying youthful offenders who commit an Article 227 offense. Its statutory age wording and the accused person’s precise age at the time should be checked carefully. mojlaw.moj.gov.tw
Separately, Article 229-1 requires a complaint for an Article 227 offense committed by someone under 18.
These provisions are sometimes described as Taiwan’s “Romeo and Juliet” rules. They do not create a blanket exemption for every relationship between young people. The conduct, ages and any allegations of force or other offenses still require examination.
9. Could Other Offenses Apply?
Yes. Article 227 is not the only relevant provision.
Article 228 may apply where someone exploits authority or an opportunity arising from a specified supervisory, educational, caregiving or similar relationship. mojlaw.moj.gov.tw
Force, threats or other conduct against the person’s will may engage separate sexual offenses.
Recording, possessing or sharing sexual images involving someone under 18 may also raise issues under the Child and Youth Sexual Exploitation Prevention Act. The age threshold for sexual images differs from Article 227’s under-16 threshold.
10. What Should You Do After Receiving a Police Notice?
Preserve complete communications. Keep relevant messages, profile information, timestamps and original context. Obtain advice before copying or handling any potentially illegal sexual images.
Avoid pressuring anyone to withdraw or change their account. Any proposed apology, compensation or settlement should be handled through an appropriate lawful process.
Respond to official notices. Confirm the agency, alleged offense, interview date and your procedural status.
Consult counsel before detailed questioning. Discuss your right to silence, the available evidence and whether a lawyer should attend.
Document your knowledge of age. Identify when age was discussed, what was said and what information was available before the alleged conduct.
➠Do not invent details, alter records or assume that a private agreement ends the investigation.
11. How Legal Consultant Can Assist
Legal Consultant can help assess:
Article 227 allegations involving intercourse or indecent acts.
Mistake of age and evidence of criminal intent.
Special provisions for younger offenders.
Complaint requirements, withdrawal and settlement procedures.
Police questioning, investigation and trial preparation.
Grounds for non-prosecution, acquittal or sentencing mitigation.
Related civil compensation and digital-evidence issues.
The appropriate strategy depends on the complete evidence and the specific allegation.
12. Understanding the Under-16 Threshold
Sexual activity with someone under 16 can constitute an offense despite apparent consent. The younger person’s exact age affects the applicable penalties, while the accused person’s age may affect special procedural and sentencing provisions.
💡At the same time, criminal intent must be assessed through evidence. Neither mature appearance nor a claimed age automatically determines the outcome.
Early review of the communications, timeline and legal requirements helps establish an accurate and appropriate response.
13. Frequently Asked Questions
▪️Is dating someone under 16 itself an Article 227 offense?
Dating alone does not automatically constitute the offense. Sexual intercourse, indecent acts or other conduct may create separate legal issues.
▪️Can there still be an offense if the younger person agreed?
Yes. Apparent consent does not automatically exclude liability under Article 227.
▪️What if the person said they were already 16?
That statement may be important evidence. Investigators will also examine whether other information showed that the accused knew or foresaw otherwise.
▪️Is mature appearance enough to establish mistake of age?
Usually, appearance alone cannot replace a complete assessment of knowledge, communications and surrounding ▪️circumstances.
Can parents file a complaint?
A parent who is the minor’s legal representative may independently file a criminal complaint. Civil claims and complaint-withdrawal rules require separate analysis.
▪️Will sexual activity between minors always result in punishment?
No. Special provisions for younger offenders may apply, alongside the relevant juvenile procedures. Eligibility and effect depend on the facts and applicable law.
▪️Can the accused receive a suspended sentence?
Possibly, if there is a conviction and the sentence, prior record and other statutory conditions qualify. It is not equivalent to acquittal or non-prosecution.
