What Is a Money Mule in Taiwan? Fraud Charges, Penalties and Legal Defense

A job involving cash collection, withdrawals or transfers may appear straightforward. However, if the money comes from a scam, the person handling it may face investigation for fraud, money laundering or participation in a criminal organization.

Can a money mule go to prison in Taiwan? Yes—but criminal liability is not automatic. Prosecutors must establish the relevant conduct and criminal intent. Someone genuinely deceived by a fake employer, loan provider or online contact may have grounds to challenge the allegations.

1. What Is a Fraud Money Mule?

In Taiwan, the term “money mule” (車手) commonly describes someone instructed by a fraud operation to withdraw, collect, transport or hand over victims’ money.

The role can include collecting cash in person, withdrawing funds from an ATM or transferring money through bank accounts or cryptocurrency platforms. Some participants receive a fee or commission.

Although the task may be described as “collection work,” “payment processing” or “helping with a transfer,” knowingly performing it as part of a fraud scheme can lead to serious criminal charges.

However, the label “money mule” does not determine guilt. The evidence must establish what the person did and what they knew or accepted about the activity.

2. How Can a Money Mule Be Liable for Fraud?

Ordinary fraud under Article 339 of Taiwan’s Criminal Code involves deception used to obtain property or an unlawful financial benefit for oneself or another person. mojlaw.moj.gov.tw

For a completed property-fraud offense, the analysis generally includes:

  • An intention to obtain property unlawfully for oneself or another person.

  • Deceptive conduct.

  • A victim being misled by that conduct.

  • The victim disposing of property because of the mistake.

  • Resulting financial loss.

➥➥A person does not have to make the scam phone call or send the fraudulent message personally to face liability as a joint principal.

If the evidence establishes shared criminal intent and participation in the scheme, collecting or withdrawing the money may form part of the jointly committed offense. In other circumstances, the evidence may support aiding and abetting—or fail to establish criminal liability.

Handling money connected to fraud is therefore an important fact, but it does not replace proof of the required intent and participation.

3. What Penalties Can a Money Mule Face in Taiwan?

▫️Ordinary Fraud and Aggravated Fraud

Under Article 339, ordinary fraud is punishable by up to five years’ imprisonment, short-term detention, or a fine of up to NT$500,000, which may also be imposed alongside imprisonment or detention. mojlaw.moj.gov.tw

Article 339-4 provides a baseline penalty of one to seven years’ imprisonment, with a possible additional fine of up to NT$1 million, where fraud involves:

  1. Impersonating a government agency or public official.

  2. Joint participation by three or more people.

  3. Disseminating fraudulent content to the public through broadcasting, telecommunications, the internet or other media.

  4. Using technology to create false images, voices or electronic records concerning another person.

Examples include impersonating a prosecutor, publishing fraudulent investment advertisements or using deepfake technology in a scam. The applicable aggravating circumstance must be established against the individual defendant. mojlaw.moj.gov.tw

▫️Higher Penalties for Large-Value Fraud

Under the current Article 43 of the Fraud Crime Hazard Prevention Act, qualifying aggravated fraud carries higher penalties based on the value of property or financial benefits the victim is induced to deliver:

  • NT$1 million or more: three to ten years’ imprisonment, with a possible additional fine of up to NT$30 million.

  • NT$10 million or more: five to twelve years’ imprisonment, with a possible additional fine of up to NT$300 million.

  • NT$100 million or more: at least seven years’ imprisonment, with a possible additional fine of up to NT$500 million.

These are the updated thresholds following the January 2026 amendment. The offense date and rules governing changes in criminal law must be considered in older cases. 全國法規資料庫

▫️Participation in a Criminal Organization

A money mule may also face charges under the Organized Crime Prevention Act if the evidence establishes participation in a qualifying criminal organization.

Article 3, Paragraph 1 provides six months to five years’ imprisonment, with a possible additional fine of up to NT$10 million, for participation. Minor participation may qualify for a reduction or exemption from punishment. 全國法規資料庫

▫️Money Laundering

Withdrawing, transferring or handing over criminal proceeds may also constitute money laundering where the statutory requirements are met.

Under Article 19 of the Money Laundering Control Act:

  • For property or financial benefits below NT$100 million, the penalty is six months to five years’ imprisonment, together with a fine of up to NT$50 million.

  • For amounts of NT$100 million or more, the penalty is three to ten years’ imprisonment, together with a fine of up to NT$100 million. mojlaw.moj.gov.tw

These charges do not mean that every statutory prison term is simply added together. The court must assess the relationship between the offenses and apply the relevant sentencing rules.

4. Can “I Didn’t Know It Was a Scam” Be a Defense?

Yes. A genuine lack of criminal intent can be central to the defense. However, a bare denial may not explain the surrounding evidence.

Investigators may examine the job advertisement, conversations, payment arrangements, instructions and the person’s response to suspicious circumstances.

💡For example, relevant questions include:

  • What did the supposed employer say the work involved?

  • Was there a credible explanation for collecting or transferring money?

  • Was the person instructed to conceal their identity or avoid bank staff?

  • Did they receive unusually high compensation?

  • Did they continue after discovering that the funds might come from fraud?

➠The prosecution retains the burden of proving guilt. A person’s failure to recognize a scam should not automatically be treated as intentional participation.

However, if someone foresaw that the activity involved fraud and accepted that possibility while continuing to assist, a court may find the necessary intent.

The defense should therefore explain the complete circumstances and support that explanation with available evidence. Useful material may include job listings, full chat histories, bank records, delivery instructions and records of inquiries or reports to authorities.

5. Can a Money Mule Also Face Civil Compensation Claims?

Yes. Victims may pursue civil compensation where the legal requirements for liability are established.

Depending on the facts, a defendant may face claims concerning losses beyond the fee or commission they personally received. Liability can depend on the person’s conduct, fault, connection to the loss and relationship with other participants.

Criminal punishment, compensation and settlement are related issues, but they require separate assessment. Returning a commission does not necessarily resolve the victim’s entire claim.

6. How Can You Avoid Being Recruited as a Money Mule?

Be cautious about jobs promising high pay for simple tasks involving cash, bank accounts or cryptocurrency.

📝Warning signs include requests to:

  • Withdraw or transport large amounts of money for strangers.

  • Collect cash using a false identity or misleading explanation.

  • Transfer funds repeatedly between unrelated accounts.

  • Purchase cryptocurrency and send it to an unfamiliar wallet.

  • Provide an ATM card, PIN or online-banking credentials.

  • Process transactions supposedly needed to improve loan eligibility.

➠Verify the organization and the purpose of the transactions before acting. If instructions appear suspicious, stop processing further funds and seek advice from your bank, the police or a qualified lawyer.

If an investigation has already begun, preserve the relevant records and obtain legal advice before giving a detailed statement.

7. Legal Defense for Money Mule Allegations

Money mule cases can involve substantial prison sentences and compensation claims. However, the outcome depends on the evidence—not simply the fact that someone collected cash or operated an account.

Legal Consultant can assist by reviewing the alleged role, communications, financial records and evidence of knowledge or intent. Where recruitment involved a fake job, loan application, investment scheme or online relationship, the defense should reconstruct how the deception occurred.

➠Depending on the case, legal work may focus on seeking non-prosecution or acquittal, challenging an aggravated charge, or presenting grounds for an appropriate sentencing outcome.

Early preparation helps ensure that important evidence is available and that the person’s explanation is accurately presented.
