Accused of Receiving Sexual Images of a Minor in Taiwan? Laws, Penalties and Legal Defense

Private messages on dating apps and social media can lead to serious legal consequences when sexual images involve someone under 18.
In Taiwan, possessing, sharing or inducing the production of sexual images involving children or adolescents may constitute an offense under the Child and Youth Sexual Exploitation Prevention Act. However, receiving an unsolicited file does not automatically establish criminal liability. The nature of the material, the recipient’s knowledge and the actions taken must be examined.
This article explains the main offenses, common disputed situations and practical steps to protect your rights during an investigation.
1. Can Receiving Sexual Images of a Minor Lead to Criminal Charges?
People facing investigation often explain: “I only received the photos,” or “We were in a relationship and exchanged them voluntarily.”
A relationship or the minor’s apparent consent does not, by itself, make the conduct lawful. Nevertheless, prosecutors must establish the elements of the particular offense. Whether the material legally qualifies as a sexual image is also important; not every photograph depicting nudity automatically receives the same legal classification.
▫️Possession: Article 39
Under Article 39, Paragraph 2, possessing sexual images of a child or adolescent without a legitimate reason is punishable by:
Up to three years’ imprisonment or short-term detention.
A possible additional fine of NT$60,000–600,000.
Paying to obtain and possess such images without a legitimate reason carries a heavier penalty under Paragraph 1: one to seven years’ imprisonment, with a possible additional fine of NT$100,000–1 million. law.moj.gov.tw
Knowingly saving or retaining prohibited images can expose a person to prosecution. Unsolicited receipt, automatic downloads and files stored in an application’s cache require closer examination of knowledge, control and intent.
➠These criminal offenses do not depend on the depicted person filing a complaint before authorities can investigate.
▫️Sharing or Forwarding: Article 38
Forwarding an image to a friend or posting it in a private group can create liability. Public posting is not the only form of distribution covered by the law.
Article 38, Paragraph 1 covers distributing, broadcasting, delivering, publicly displaying or otherwise making the specified material available to others. The penalty is one to seven years’ imprisonment, with a possible additional fine of up to NT$5 million.
➠Possessing the material with an intention to distribute it is a separate offense carrying six months to five years’ imprisonment, with a possible additional fine of up to NT$3 million. Profit-motivated conduct or selling the material can result in increased punishment. law.moj.gov.tw
▫️Inducing a Minor to Create Images: Article 36
Asking, persuading or assisting a minor to produce sexual images may involve a more serious offense than possession.
Under Article 36, Paragraph 2, recruiting, inducing, assisting or otherwise causing a child or adolescent to be photographed or to create sexual images carries three to ten years’ imprisonment, with a possible additional fine of up to NT$3 million.
➠Using violence, coercion, deception or other methods against the person’s will falls under Paragraph 3, carrying at least seven years’ imprisonment, with a possible additional fine of up to NT$5 million. The precise classification depends on what happened. law.moj.gov.tw
2. Common Situations and Possible Defense Issues
The following examples illustrate potential legal issues rather than report specific court decisions.
▫️Example 1: A Dating-App Contact Misrepresented Their Age
An adult meets someone online who claims to be 20. They exchange private images. Months later, police execute a search warrant, and the adult learns that the other person was actually 16.
➟A central issue is what the accused knew or foresaw about the person’s age.
Messages containing age claims, profile information and the full conversation may help establish the circumstances. However, a false age statement does not automatically guarantee non-prosecution or acquittal. Investigators will consider whether other information indicated that the person was under 18 and whether the accused recognized that possibility.
➟A lawyer can assess whether the evidence supports a genuine mistake about age and whether the necessary criminal intent can be established.
▫️Example 2: A Group-Chat File Was Automatically Downloaded
Someone posts a sexual video involving a minor in a large messaging group. Another member says they never opened it, but the application stored the file automatically.
The presence of a file on a device is relevant evidence, but the circumstances still matter.
Legal and forensic review may examine:
Whether the person knew the file existed.
Whether it was opened or deliberately saved.
How the application downloaded or cached it.
Whether the person could access and control it.
Whether it was subsequently retained or forwarded.
➟Automatic storage does not automatically establish guilt, and it does not automatically exclude liability. The complete digital evidence and the person’s conduct must be assessed.
3. What Should You Do If You Are Investigated?
1. Stay Calm and Obtain Advice Before Changing Device Data
Do not panic-delete conversations, reset devices or alter records to conceal what happened. Such actions may destroy helpful evidence and create further concerns during the investigation.
At the same time, do not make additional copies of suspected illegal images or forward them to friends for advice. Ask a lawyer how to preserve relevant evidence and arrange lawful handling of the material.
2. Preserve Evidence About Age and Context
Relevant evidence may include messages about age, dating profiles, the circumstances in which files arrived and records showing your response.
Preserve the full context rather than selecting isolated messages. Avoid copying the sexual material itself when documenting non-explicit profile information or conversations; obtain advice on an appropriate preservation method.
Prepare an accurate timeline identifying what you knew, when you learned it and what you did afterward.
3. Exercise Your Right to Silence and Seek Counsel
Taiwan’s Code of Criminal Procedure recognizes a defendant’s rights to remain silent, appoint a defense lawyer and request investigation of favorable evidence. law.moj.gov.tw
Before questioning, clarify your procedural status and the alleged offense. You can explain that you wish to consult a lawyer before answering substantive questions.
If you provide a statement, be truthful. Do not guess dates, invent explanations or agree with a question that inaccurately describes what happened. Read the interview record carefully and request corrections before signing.
4. Have a Lawyer Assess the Specific Allegation
A lawyer can help distinguish between:
Unsolicited receipt and intentional possession.
Possession and distribution.
Receiving existing material and inducing its creation.
Genuine lack of knowledge and awareness of a minor’s age.
Counsel can also review search and seizure procedures, examine digital evidence and prepare legal submissions.
The available outcomes depend on the charge. Deferred prosecution is generally unavailable for offenses carrying a statutory minimum prison term of three years or more, which is particularly relevant to Article 36, Paragraph 2. law.moj.gov.tw
4. Legal Consultant: Assistance With Child Sexual Exploitation Allegations
An investigation involving sexual images of minors can affect your freedom, employment and reputation. Early legal preparation helps ensure that the relevant evidence and your explanation are properly presented.
Legal Consultant can assist with:
Representation during questioning: explaining procedural rights and helping ensure an accurate interview record.
Review of digital evidence: examining communications, file-access records and the circumstances of receipt or storage.
Defense preparation: assessing the legal elements and seeking non-prosecution, acquittal or an appropriate sentencing outcome where supported by the evidence.
Where relevant, lawful settlement and compensation may form part of mitigation. They do not automatically end prosecution or guarantee a suspended sentence.
