Can a Final Drug Trafficking Conviction Be Reopened in Taiwan? Grounds for a Retrial Explained

Receiving a notice to report for sentence execution can be frightening. A common first question is: “Can I still appeal?”
Once a criminal judgment becomes final, the ordinary appeal process has generally ended. However, Taiwan law provides exceptional remedies, including an application for a retrial.
💡A retrial is not simply another opportunity to disagree with the court. The application must identify a statutory ground and explain how the supporting evidence could affect the final judgment.
This article examines potential grounds for reopening a drug trafficking case, the main legal requirements and how a lawyer can assess whether further relief is available.
1. New Facts or New Evidence
Article 420, Paragraph 1, Subparagraph 6 of Taiwan’s Code of Criminal Procedure permits a retrial application where newly discovered facts or evidence, considered alone or together with the earlier evidence, sufficiently support an acquittal, a judgment barring prosecution, exemption from punishment or conviction for a less serious offense.
“New” evidence can include material that existed before the judgment became final but was not investigated or considered, as well as facts or evidence arising afterward. law.moj.gov.tw
In drug cases, the following situations may warrant examination.
▫️A Drug Supplier Is Located After the Conviction Becomes Final
Under Article 17, Paragraph 1 of the Narcotics Hazard Prevention Act, a person convicted of specified drug offenses qualifies for a reduction or exemption from punishment where disclosure of the drug source leads authorities to apprehend another principal offender or accomplice. mojlaw.moj.gov.tw
Sometimes the accused supplies information during the investigation, but authorities locate the supplier only after the accused’s own judgment becomes final.
➠That later development may provide grounds for a retrial application. Important questions include whether the disclosure actually led to the apprehension and whether the supplier was connected to the drugs involved in the original case.
➠The supplier’s later apprehension does not automatically reopen the conviction. The statutory requirements and supporting investigation records must still be established.
▫️New Scientific Analysis Challenges the Original Findings
A new forensic method or expert analysis may reveal a material problem with the evidence supporting the conviction.
For example, a reliable examination might challenge the identification of a substance or a finding about the composition or quantity relevant to the offense.
The existence of a newer testing method alone is insufficient. The application should explain what the new analysis establishes, why it is reliable and how it could support a legally qualifying outcome.
▫️A Key Witness Changes Their Account
A buyer or alleged accomplice may later withdraw or substantially change testimony relied on at trial.
A recantation may warrant investigation, but a changed account is not automatically reliable new evidence. The court will need to assess the explanation for the change, consistency with other evidence and any independent support.
The relevant question is whether the new material, considered with the complete record, sufficiently undermines the basis of the final judgment.
2. Testimony, Expert Evidence or Interpretation Is Proven False
Article 420, Paragraph 1, Subparagraph 2 provides a separate ground where testimony, expert evidence or interpretation relied on in the original judgment is proven false.
This ground has an additional requirement. Ordinarily, the falsity must be established by a final judgment. Alternatively, the relevant criminal proceedings must be unable to begin or continue for a reason other than insufficient evidence.
➠For example, a final perjury conviction may be relevant. A witness merely saying that an earlier statement was inaccurate does not, by itself, satisfy this particular statutory route. law.moj.gov.tw
A lawyer should distinguish this ground from an application based on newly discovered evidence.
3. Important Evidence Was Overlooked: The Limited Scope of Article 421
Article 421 permits a retrial application where a conviction became final at the second instance in a case legally ineligible for a third-instance appeal, and the court failed to consider important evidence capable of affecting the judgment. law.moj.gov.tw
➠This provision is not a general remedy for every case ending after a second-instance judgment.
In particular, drug trafficking cases should not automatically be described as ineligible for a third-instance appeal. Supreme Court proceedings do include convictions for selling Category Two narcotics. cons.judicial.gov.tw
Before relying on Article 421, counsel must verify the offense, procedural history and statutory appeal restrictions. An appeal that was never filed, withdrawn or rejected does not necessarily place the case within Article 421.
4. Why Retrial Applications Require Careful Preparation
▫️The Evidence Must Have a Material Effect
A retrial application should explain more than why a document, recording or statement is newly available.
It should identify the original finding being challenged and show how the new evidence could support the legally required outcome.
➠Repeating an argument that the original court already examined, without materially new support, will generally not establish a new-evidence ground.
▫️Disclosure of a Drug Source Must Be Relevant and Causally Connected
For an Article 17 claim, the application should address:
What information the convicted person supplied.
When and to whom it was supplied.
What authorities already knew.
How the disclosure contributed to apprehending another offender.
How that offender relates to the drugs in the original case.
Information about an unrelated drug offense does not automatically establish entitlement to relief in the convicted person’s case.
▫️A Request for Leniency Is Different From a Retrial Ground
New information about personal hardship or reasons for a more lenient sentence does not automatically justify reopening a final conviction.
However, it would also be incorrect to say that retrial relief requires a provision mandating complete exemption from punishment.
➠In Constitutional Court Judgment No. 2 of 2023, the Court held that the relevant retrial ground must encompass statutory provisions allowing reduction or exemption from punishment, rather than being confined to provisions requiring exemption alone. The underlying cases involved drug-source disclosures followed by apprehension after the applicants’ convictions became final. cons.judicial.gov.tw
Older decisions applying a narrower interpretation must therefore be assessed against this constitutional judgment.
▫️Legal Errors May Require a Different Remedy
A complaint about incorrect legal application may need to be examined through the extraordinary-appeal framework rather than presented as newly discovered evidence.
➠An extraordinary appeal is a separate procedure initiated by the Prosecutor General. It is not an ordinary appeal that a convicted person can file directly.
Counsel should identify the nature of the alleged error before choosing the appropriate route.
5. Does Applying for a Retrial Stop Imprisonment?
No. Filing a retrial application does not automatically suspend sentence execution.
Article 430 states that an application has no automatic suspensive effect. Before the retrial ruling, the prosecutor at the prosecutors office corresponding to the competent court may order a suspension. law.moj.gov.tw
➠A person who receives a notice to report for sentence execution should therefore address that notice promptly. Filing an application is not permission to disregard the reporting date.
Any request concerning suspension of execution requires separate consideration.
6. How a Lawyer Can Assess Your Options
A useful assessment begins with the complete record: the judgments at each court level, relevant evidence, investigation documents and the proposed new material.
Legal Consultant can assist with:
Checking when and how the judgment became final.
Identifying the statutory ground potentially available.
Comparing new evidence with findings in the original judgment.
Examining drug-source disclosure and apprehension records.
Assessing whether a retrial or another remedy is appropriate.
Preparing an application explaining the evidence and its legal significance.
In drug trafficking, cross-border transportation and manufacturing cases, the distinction between new evidence, a sentencing argument and a legal error can determine whether an application addresses the correct issue.
➠A final conviction does not eliminate every possibility of relief, but reopening the case requires specific legal grounds and persuasive supporting evidence. If you believe material evidence was missed or a later development changes the legal position, obtain a review of the complete case file promptly.
👨🏻⚖️This article provides general information about Taiwan law. Whether a retrial is available depends on the applicable legislation, procedural history and complete evidence. Acceptance of a retrial application does not guarantee acquittal or a reduced sentence.
