Tricked into Being a Money Mule in Taiwan? Criminal Charges, Suspended Sentences and Acquittal Explained

A seemingly simple job collecting cash or transferring money can lead to a criminal investigation when the funds come from fraud.

In Taiwan, a money mule, commonly called a 車手, may face allegations of fraud, money laundering or participation in a criminal organization. Typical activities include:

  • Withdrawing cash from bank accounts.

  • Collecting payments and handing them to another person.

  • Transporting or transferring suspected criminal proceeds.

➠However, handling money connected to a scam does not automatically establish guilt. Prosecutors must prove the elements of the alleged offense, including the required criminal intent.

If you were deceived by a fake employer, loan provider, friend or online romantic contact, the circumstances and supporting evidence can be central to your defense.

1. When Can a Money Mule Face Aggravated Fraud Charges?

Article 339-4 of Taiwan’s Criminal Code provides a baseline penalty of one to seven years’ imprisonment, with a possible additional fine of up to NT$1 million, for fraud involving any of these four circumstances:

  1. Impersonating a government agency or public official.

  2. Joint participation by three or more people.

  3. Disseminating fraudulent content to the public through broadcasting, telecommunications, the internet or other media.

  4. Using technology to create false images, voices or electronic records concerning another person. mojlaw.moj.gov.tw

➠Using the internet does not, by itself, satisfy the third category: the provision specifically concerns dissemination to the public.

➠Likewise, a larger fraud operation’s existence does not automatically prove that every participant knew or foresaw involvement by three or more people. The evidence relating to the individual defendant still matters.

Additional legislation may impose heavier penalties where further statutory requirements are met, so this baseline is not the maximum exposure in every case.

2. How Fraud Operations Use Money Mules

A fraud operation may divide responsibilities among:

  • Organizers: planning the scheme and assigning tasks.

  • Scam callers or message operators: contacting and deceiving victims.

  • Account suppliers or collectors: obtaining accounts and payment credentials.

  • Money-laundering handlers: moving funds and obscuring their trail.

  • Money mules: withdrawing cash or collecting payments in person.

➠Cash withdrawals and collections can leave identifiable evidence, including ATM footage, bank records and communications.

➠Nevertheless, the prosecution must establish the accused person’s actual role and state of mind. Being present at a collection or appearing in surveillance footage does not answer every question about criminal responsibility.

3. Money Laundering Charges and Penalties

Withdrawing, transferring or handing over fraud proceeds may also constitute money laundering where the statutory requirements are established.

Under Article 19 of the Money Laundering Control Act:

  • For property or financial benefits below NT$100 million, the penalty is six months to five years’ imprisonment, together with a fine of up to NT$50 million.

  • For amounts of NT$100 million or more, the penalty is three to ten years’ imprisonment, together with a fine of up to NT$100 million.

➠Attempts are also punishable. mojlaw.moj.gov.tw

➠The assessment should examine the source of the funds, the defendant’s knowledge and how their conduct relates to the alleged laundering activity. An ordinary transfer should not automatically be equated with money laundering.

4. Participation in a Criminal Organization

A separate charge may arise if the evidence establishes participation in a qualifying criminal organization.

Article 3 of the Organized Crime Prevention Act provides:

  • Organizing, directing or controlling a criminal organization: three to ten years’ imprisonment, with a possible additional fine of up to NT$100 million.

  • Participating in a criminal organization: six months to five years’ imprisonment, with a possible additional fine of up to NT$10 million.

Minor participation may qualify for reduced punishment or exemption. mojlaw.moj.gov.tw

Repeated assignments, established roles and communications about coordinated transactions may be relevant. However, a fraud allegation does not automatically prove membership in a criminal organization.

5. Can There Be Criminal Liability If No Money Was Collected?

Yes. An unsuccessful operation can still involve an attempted offense.

Article 25 of the Criminal Code addresses conduct that has begun the execution of an offense but does not succeed. Attempts are punishable where the law specifically provides for them, and the punishment may be reduced compared with a completed offense. Aggravated fraud expressly includes attempt liability. mojlaw.moj.gov.tw

➠However, failure to withdraw cash does not automatically mean the entire fraud remained an attempt. A victim may already have transferred money before an account was frozen.

The court must examine the stage reached by the alleged offense and the defendant’s involvement.

6. Non-Prosecution, Deferred Prosecution, Acquittal and Suspended Sentences

These outcomes have different meanings.

▫️Non-Prosecution

A prosecutor may decide not to prosecute where the applicable grounds are established, including insufficient evidence of criminal responsibility.

In a recruitment-scam case, useful evidence may include the original job advertisement, full conversations, instructions, transaction records and the person’s response after discovering the problem.

➠Not receiving payment does not automatically establish innocence, and following instructions does not automatically establish guilt. The complete circumstances matter.

A non-prosecution decision is not a conviction, although records of the investigation may remain.

▫️Deferred Prosecution

For eligible offenses, a prosecutor may defer prosecution for one to three years, potentially subject to conditions.

Eligibility depends on the charge and statutory requirements. Offenses punishable by death, life imprisonment or a statutory minimum prison term of at least three years are generally excluded. law.moj.gov.tw

➠Deferred prosecution is therefore not available in every money mule case and should not be confused with acquittal.

▫️Acquittal

After prosecution, the court may acquit if criminal responsibility is not proven to the required standard.

A genuine lack of knowledge or criminal intent may be decisive where supported by the evidence. The prosecution retains the burden of proving guilt.

▫️Suspended Sentence

A suspended sentence follows a conviction. It suspends execution of the sentence subject to legal requirements and any imposed conditions.

Article 74 generally concerns sentences of up to two years’ imprisonment, short-term detention or a fine, together with requirements concerning prior convictions and the court’s assessment. The suspension period is two to five years. mojlaw.moj.gov.tw

➠A suspended sentence can help an eligible defendant avoid immediate imprisonment, but it remains different from non-prosecution or acquittal and may be revoked in specified circumstances.

7. What Should You Do If Accused of Being a Money Mule?

  1. Clarify the allegation and your procedural status. Check the police notice, alleged offense and interview date.

  2. Consult a criminal defense lawyer before detailed questioning. You may exercise your right to remain silent while obtaining advice.

  3. Preserve complete records. Keep advertisements, messages, bank statements, transfer instructions and other relevant documents.

  4. Prepare an accurate timeline. Explain what you believed the task involved and when you first noticed anything suspicious.

  5. Have the available outcomes assessed individually. The appropriate approach depends on the evidence, charges and procedural stage.

Do not invent details, delete relevant records or coordinate accounts with other people.
