Hong Kong Resident Arrested in Taiwan for Fraud? Detention, Lawyer Visits and Bail Explained

A job offer or investment opportunity in Taiwan can become a criminal investigation when someone is recruited to collect, withdraw or transfer money connected to a scam.

For families in Hong Kong, the situation can be especially distressing. A relative may suddenly stop responding, and the family may later learn that they have been arrested or placed in detention with restrictions on visits and correspondence.

💡Detention does not mean the person has been convicted. Restrictions on family contact also do not ordinarily prevent access to a defense lawyer.

➠This article explains common recruitment scenarios, how detention decisions are made and what families can prepare when seeking legal assistance in Taiwan.

1. How Can Someone From Hong Kong Become a Money Mule in Taiwan?

A money mule, commonly called a 車手 in Taiwan, may be instructed to withdraw cash, collect payments or hand funds to another person.

Recruitment can take several forms.

▫️A Job Offer Turns Into Cash Collection Work

An online advertisement may promise a well-paid customer-service or financial-assistant position. After arriving in Taiwan, the person is instead instructed to visit ATMs, withdraw money or collect cash from strangers.

The advertised role, actual instructions and explanation given for the payments can become important evidence.

▫️An Investment Arrangement Requires Receiving or Transferring Funds

A supposed investment company or online contact may ask someone to receive payments, use their bank account or purchase cryptocurrency. If those funds come from fraud, the person handling them may become a suspect. Investigators must still examine what they knew and whether the required criminal intent existed.

💡“Quick Money” Recruitment Involves Threats or Passport Confiscation

Some recruits may encounter threats, restrictions on movement or confiscation of travel documents after arrival.

These circumstances require careful investigation. Evidence of coercion, deception or exploitation may be relevant to the defense and may also require assessment of possible trafficking-victim protections.

➠Collecting money does not automatically prove knowing participation in fraud. Equally, describing the arrangement as a job does not automatically exclude liability.

2. What Does Detention With Contact Restrictions Mean?

The Chinese expression 羈押禁見 generally refers to detention accompanied by restrictions on visits, correspondence or other outside contact.

▫️Who Decides Whether Someone Is Detained?

During an investigation, the prosecutor may apply for detention. A judge decides whether detention is legally justified.

Article 101 of Taiwan’s Code of Criminal Procedure requires strong suspicion of an offense, a statutory ground—such as a fact-based risk of flight or interference with evidence—and the necessity of detention. The seriousness of an allegation alone does not settle every requirement. law.moj.gov.tw

In a cross-border fraud case, authorities may examine travel arrangements, connections in Taiwan, access to other ➠suspects and the possibility of influencing witnesses or evidence.

Being a Hong Kong resident is not, by itself, a complete explanation of why detention is necessary.

▫️Why Might Family Contact Be Restricted?

Article 105 permits restrictions where outside contact creates relevant risks, including escape, destruction or alteration of evidence, or collusion with accomplices or witnesses. Restrictions must not impair legitimate defense rights. law.moj.gov.tw

A restriction on family visits does not automatically prohibit meetings with defense counsel. Article 34 separately protects lawyer communication with an arrested or detained accused person, subject to legally authorized exceptions. law.moj.gov.tw

➠A lawyer can seek to confirm the person’s location, arrange a legal visit and explain the procedural position. Information shared with relatives remains subject to confidentiality and the client’s authorization.

3. How Can a Lawyer Seek Bail?

Under Article 110, the accused, defense counsel and certain legally eligible persons may apply to the court for suspension of detention on bail. law.moj.gov.tw

A persuasive application should address the reasons for detention directly.

▫️Examine the Allegations and Supporting Evidence

Where the person says they were deceived, counsel may review:

  • Recruitment advertisements and employment discussions.

  • Complete messages with recruiters or investment contacts.

  • Travel bookings and accommodation arrangements.

  • Payment instructions and promised compensation.

  • Bank transactions and cryptocurrency records.

  • Evidence of threats, passport confiscation or attempts to leave.

This review helps assess both the strength of the allegations and the person’s actual role.

▫️Address Flight and Evidence-Interference Risks

An application may explain why the identified risks can be managed without continued detention.

Relevant material may include a verified address in Taiwan, a practical plan for attending proceedings, available support and evidence that important records have already been secured.

Having no previous convictions or being willing to cooperate does not automatically establish entitlement to bail. Those facts should be connected to the specific grounds relied on for detention.

▫️Propose Suitable Conditions

Depending on the circumstances, counsel may propose:

  • An appropriate bail amount.

  • A designated residence.

  • Regular reporting.

  • Restrictions on contact with specified people.

  • Other legally available measures addressing the identified risks.

Courts may impose conditions when suspending detention under Article 116-2. law.moj.gov.tw

A restriction on residence and a prohibition on leaving Taiwan are different measures. Release on bail does not automatically permit an immediate return to Hong Kong. Any departure restrictions and immigration requirements must be checked separately.

➠There is no guaranteed bail amount or timetable. The court assesses the evidence, risks and proposed arrangements in each case.

4. What Happens After Release on Bail?

Bail concerns whether the person remains detained while proceedings continue. It does not determine guilt or end the case.

After release, legal preparation may include:

  • Testing whether the evidence establishes knowing participation.

  • Distinguishing the person’s conduct from that of other participants.

  • Reviewing the basis for aggravated fraud, money-laundering or organized-crime allegations.

  • Seeking non-prosecution where supported by the evidence.

  • Assessing deferred prosecution where legally available.

  • Preparing a trial defense or relevant sentencing material.

➠An acquittal, non-prosecution decision and suspended sentence have different legal effects. None follows automatically from being granted bail.

➠The person must also comply with attendance requirements and every condition of release.

5. What Should Family Members in Hong Kong Prepare?

Families can help by gathering accurate information rather than relying on fragments from friends or online contacts.

⚠️Useful materials include:

  • The relative’s full name and identification details.

  • Their arrival date, travel itinerary and last known location.

  • Any police, prosecutor, court or detention-center information.

  • Notices, case numbers and existing detention orders.

  • Recruitment messages, job advertisements and payment records.

  • Medical information or urgent medication needs.

  • Information about possible accommodation and support in Taiwan.

➠Do not delete messages or contact suspected participants to coordinate explanations. Preserve the original communications for legal review.

➠If the detained person has difficulty understanding Mandarin, raise the need for appropriate interpretation promptly.
