Does a Fraud Report Automatically Freeze Your Bank Account in Taiwan? Warning Accounts, Restrictions and Compensation ExplainedIf someone reports a payment as fraudulent, will the recipient’s bank account automatically be frozen? Can restrictions extend to other accounts? Who is responsible if an account holder suffers financial loss?

👨🏻‍⚖️A fraud report does not automatically create a warning-account designation. However, Taiwan law permits authorities and financial institutions to restrict suspicious transactions before a criminal case reaches judgment.

Understanding the difference between a warning account, a linked restricted account, an abnormal-transaction restriction and a hold on specific funds is essential when seeking to restore access.

1. Does Filing a Fraud Report Automatically Create a Warning Account?

No. A report may trigger an investigation, but a formal designation requires a separate notification process.

Article 9, Paragraph 4 of Taiwan’s Fraud Crime Hazard Prevention Act authorizes judicial police investigating fraud to notify financial institutions and virtual-asset service providers to designate suspected accounts as warning accounts and suspend their transaction functions. Article 8 separately provides for controls on suspicious activity. law.moj.gov.tw

💡The stages should therefore be distinguished:

1. Someone reports suspected fraud.

2. Investigators assess the available information.

3. The competent authority issues a notification.

4. The institution implements the applicable restrictions.

Banks may also investigate unusual activity and impose restrictions under their own statutory obligations. A bank’s abnormal-transaction controls are not necessarily the same as a formal warning-account designation.

➠Ask the bank which measure applies rather than relying only on the general description “frozen account.”

2. Why Can Transactions Be Restricted Before a Court Judgment?

These measures are designed to interrupt suspicious money flows while an investigation proceeds.

They are different from a criminal conviction or a court order confiscating the account holder’s property.

Fraud proceeds can move quickly between accounts. Requiring a final conviction before taking protective measures could leave little money available to recover.Nevertheless, early intervention still requires a legal basis. Questions may arise where the wrong account is identified, the factual basis is inadequate or restrictions continue after the relevant concerns have been resolved.

🔎Whether a measure was unlawful requires examination of the notification, evidence, scope and handling of the particular case. A warning-account designation alone does not prove that the account holder committed fraud.

3. Will All Accounts in Your Name Become Warning Accounts?

Not automatically. Different restrictions can affect different accounts.

Formal Warning AccountsUnder the banking regulations, a warning account is a deposit account designated following notification from a court, prosecutors office or judicial police authority for a criminal investigation. law.fsc.gov.tw

Linked Restricted Accounts

➠Other deposit accounts opened by the same holder fall within the regulations’ category of 衍生管制帳戶, described here as linked restricted accounts.

Their treatment differs from a formal warning account. Restrictions include suspension of ATM-card, telephone-transfer, online-transfer and other electronic-payment functions. Incoming transfers are returned. For counter withdrawals or transfers, the bank may require documents explaining the transaction and may refuse it if no reasonable explanation is provided. law.banking.gov.tw

Holds on Specific Funds

Article 10 establishes coordinated reporting and holds on notified funds or virtual assets, with continued monitoring and possible further controls. This is not a rule automatically turning every account belonging to the same person into a formal warning account. law.moj.gov.tw

🚨The practical question is which restriction applies to each account and who has authority to remove it.

4. Does the Bank’s Statutory Protection Prevent Every Compensation Claim?

Article 12 protects financial institutions and virtual-asset service providers from compensation liability for damage arising from the anti-fraud measures specified in the Act or their cooperation with the relevant authorities. law.moj.gov.tw

This protection is significant. An account restriction causing inconvenience or financial loss does not automatically mean the bank must pay compensation.

🚨However, a potential claim still requires examining whether the disputed conduct falls within that protection. Relevant questions may include:

▪️Was the institution implementing a measure covered by the Act?

▪️What notification or legal authority supported the action?

▪️Did the institution act on the correct account?

▪️Did its actions correspond to the notification?

▪️ Was there a separate handling error?

▪️Can the claimed loss be connected to that conduct?

It would be unsafe to assume either that the bank always owes compensation or that every conceivable error is automatically protected. The scope of Article 12 and the evidence must be assessed individually.

5. How Can You Apply to Remove a Warning-Account Designation?

Step 1: Identify the Restriction

Ask the bank:

▪️ Is this a formal warning account or another transaction restriction?

▪️Which authority issued the notification?

▪️What is the notification date or reference number?

▪️ Are other accounts subject to linked restrictions?

▪️ Which functions are currently unavailable?

Keep written replies, branch-visit records and details of telephone conversations.

Step 2: Contact the Responsible Authority

Banking regulations direct account holders with questions about a warning designation to the original notifying authority. Banks should provide assistance where necessary.

Formal restrictions are generally removed following notification from that authority or expiry of the applicable warning period. Linked or abnormal-account restrictions must be removed when the bank verifies that the relevant suspicious circumstances have disappeared. law.fsc.gov.tw

Step 3: Prepare the Evidence

Organize relevant documents chronologically:

▪️ Identification and bank notices.

▪️ Account statements and transaction details.

▪️Police-report records and case references.

▪️ Contracts, orders, invoices and delivery records.

▪️ Payment, refund and reconciliation records.

▪️ Complete messages, emails and other communications.

▪️Employment or business documents explaining the transaction.

▪️ Evidence showing who controlled the account, card, phone and authentication tools.

If an account was opened through identity misuse, additional identity and credit-report documents may be relevant.

💡Police guidance distinguishes ordinary commercial disputes or accounts exploited without being handed over from accounts supplied to others through job, loan or account-rental arrangements. The early-release procedure for the former category does not automatically apply to the latter. nh.police.gov.taipei

Step 4: Follow Up With the Required Judicial Documents

Where the application depends on the criminal case’s outcome, confirm which documents are required. These may include a non-prosecution decision, judgment, proof of finality or documents confirming completion of relevant conditions or sentence execution.

➠Do not assume that receiving a favorable decision automatically restores every banking function. Check that the release notification has been processed and ask whether any separate restrictions remain.

6. Who May Be Responsible for Losses?

▫️The Fraud Offender

The person committing the fraud is a primary potential defendant for recovery of money and compensation. The available route may involve criminal proceedings, settlement, mediation or civil litigation.

The Account Holder

An account being registered in someone’s name does not automatically establish criminal complicity or civil liability.Relevant issues include knowledge, account control, compensation received, instructions followed and participation in withdrawals or transfers.

Criminal intent and civil fault are different legal questions. Negligence should not simply be treated as proof of intentional fraud or money laundering.

▫️The Financial Institution

Article 12 may protect the institution where the conduct falls within the statutory exemption.A claim concerning an alleged separate error requires assessment of the conduct, applicable duties, loss and causation.

▫️The Public Authority

Article 2 of Taiwan’s State Compensation Law may be relevant where an official intentionally or negligently exercises public authority unlawfully and infringes protected rights, causing loss. Additional eligibility rules apply where the claimant is a foreign national. law.moj.gov.tw

📝A later non-prosecution decision or acquittal does not automatically establish that the original notification was unlawful. The information and legal basis available when the measure was taken remain important.

7. Three Common Mistakes to Avoid

Deleting evidence. Messages and transaction records may explain a legitimate payment or show how the account was exploited.Paying strangers to “unfreeze” the account. Do not follow unfamiliar transfer instructions or hand over banking credentials, cards or verification codes.
