Methadone Laws in Taiwan: Category 2 Drug Classification, Legal Treatment and Criminal Penalties

Methadone is both a Category 2 narcotic under Taiwan’s Narcotics Hazard Prevention Act and a Schedule 2 controlled drug under its medical regulatory system. These classifications serve different purposes and do not contradict each other. www.tnc.moj.gov.tw

Methadone can lawfully be used in authorised medical treatment. However, obtaining, using, possessing or supplying it outside lawful channels may lead to criminal liability.

💡The key question is therefore how the methadone was obtained, administered and used. This guide explains the distinction between legitimate treatment and illegal conduct, the potential penalties and what to do if police investigate.

1. Is Methadone Legal in Taiwan?

Methadone—known locally as 美沙冬 and sometimes 美沙酮—is a synthetic opioid with recognised medical uses.

Taiwan regulates it through two separate legal systems:

  • Category 2 narcotic under the Narcotics Hazard Prevention Act: This classification addresses illegal use, possession, manufacture, transportation, sale and transfer.

  • Schedule 2 controlled drug under the Controlled Drugs Act: This classification regulates legitimate medical and scientific use, including prescribing, dispensing and storage.

➠Taiwan’s legislation expressly distinguishes narcotics control from the regulation of medical and scientific use. Methadone’s medical use does not remove it from narcotics classification, while that classification does not prohibit properly authorised treatment. law.moj.gov.tw

➠For patients, lawful access depends on the applicable treatment arrangements—not simply on possessing a medicine bearing a hospital label.

2. Why Is Methadone Used to Treat Opioid Dependence?

Methadone maintenance treatment helps people with opioid use disorder manage withdrawal symptoms and cravings. Under medical supervision, it can reduce heroin use and repeated injecting while supporting continuing treatment and recovery. mohw.gov.tw

Taiwan’s framework provides for designated treatment institutions and methadone administration sites. Participating facilities must meet professional and operational requirements, with medication administered under the relevant medical instructions and supervision. www.mohw.gov.tw

🔎Patients should:

  • Follow the treating clinician’s instructions and administration-site rules.

  • Consult the clinic about missed appointments, travel or changes in work location.

  • Avoid changing or stopping treatment without medical advice.

  • Never share, sell or exchange their medication.

➠Treatment is patient-specific. Giving methadone to someone else is not an acceptable substitute for that person receiving their own medical assessment.

3. What Are the Penalties for Illegal Methadone Use or Possession?

▫️Illegal use

Article 10(2) of the Narcotics Hazard Prevention Act provides a maximum sentence of three years’ imprisonment for using a Category 2 narcotic.

This is the statutory maximum, not an automatic sentence. The person’s history and eligibility for statutory treatment procedures also matter. law.moj.gov.tw

A positive methadone test does not, by itself, establish that the source or use was illegal. Someone receiving authorised treatment should provide records explaining when and where medication was administered.

Treatment does not, however, authorise additional private purchases or the illegal use of heroin, methamphetamine or other substances.

▫️Illegal possession

Under Article 11:

  • Ordinary possession of a Category 2 narcotic carries up to two years’ imprisonment, short-term detention or a fine of up to NT$200,000.

  • Possession involving 20 grams or more of pure narcotic content carries six months to five years’ imprisonment, with a possible additional fine of up to NT$700,000. law.moj.gov.tw

For liquid methadone or other preparations, the aggravated threshold concerns pure narcotic content—not the combined weight of the bottle, packaging and liquid.

Lawful medical administration and unauthorised possession require different legal assessments. Treatment records, laboratory findings and evidence of the actual source are therefore important.

4. Selling, Transporting or Sharing Methadone Can Carry Severe Penalties

Illegal manufacture, transportation or sale of a Category 2 narcotic carries life imprisonment or at least ten years’ imprisonment, with a possible additional fine of up to NT$15 million, under Article 4(2). law.moj.gov.tw

Possession with intent to sell is a separate offence. Article 5(2) provides at least five years’ imprisonment, with a possible additional fine of up to NT$5 million. law.moj.gov.tw

⚠️Investigators may examine messages, payments, packaging, quantities, delivery arrangements and witness accounts when distinguishing personal possession from commercial activity. Possession alone does not automatically establish an intention to sell.

▫️Giving it away is not necessarily lawful

Payment is not essential to an unlawful transfer allegation. Sharing medication with a friend—even with the intention of helping them stop using heroin—may constitute a transfer.

Article 8(2) provides six months to five years’ imprisonment, with a possible additional fine of up to NT$700,000, for transferring a Category 2 narcotic. Other aggravating provisions may apply. law.moj.gov.tw

Inducing another person to use a Category 2 narcotic may separately attract one to seven years’ imprisonment, with a possible additional fine of up to NT$1 million, under Article 7(2). law.moj.gov.tw

➠There are also serious health risks. Methadone requires individual clinical assessment, and combining it with heroin or sedating medicines can cause dangerous toxicity. www.cdc.gov.tw

5. Does Entering Treatment Prevent Prosecution?

Receiving treatment does not automatically resolve an existing criminal case. Ordinary medical treatment and statutory criminal procedures must be considered separately.

▫️Voluntary treatment before discovery

Article 21 provides a specific protection for qualifying Category 1 or Category 2 drug-use cases where the person voluntarily seeks treatment at a designated institution before the offence is discovered.

If the qualifying person is subsequently discovered during treatment, the legislation provides for non-prosecution or the corresponding juvenile disposition, subject to a once-only limitation. Timing and eligibility are essential. law.moj.gov.tw

Starting treatment after police have discovered the alleged offence should not be assumed to produce the same protection.

▫️Observation, rehabilitation and compulsory treatment

Eligible drug-use cases may involve observation and rehabilitation for up to two months. Where continued drug-use tendencies are established, compulsory treatment may follow for six months to one year.

Previous treatment history and the timing of any repeat offence affect the applicable procedure. law.moj.gov.tw

▫️Deferred prosecution with treatment conditions

In appropriate cases, prosecutors may grant conditional deferred prosecution involving addiction treatment. This is not an acquittal or a declaration that the conduct was lawful.

The person must comply with the imposed conditions. Revocation can result in continued investigation or prosecution. Methadone treatment may be relevant to the treatment plan, but attendance alone does not automatically entitle someone to deferred prosecution. law.moj.gov.tw

6. Can a Sentence Be Converted to a Fine or Suspended?

Eligibility depends on the offence and sentence—not simply on methadone’s Category 2 classification.

Under Criminal Code Article 41, conversion to a fine generally requires an offence carrying a statutory maximum of no more than five years and an imposed sentence of no more than six months’ imprisonment or short-term detention. Statutory exceptions still apply. law.moj.gov.tw

Some illegal-use or possession cases may meet these requirements. Serious trafficking offences do not satisfy the ordinary statutory-maximum requirement.

🚨A suspended sentence is different. Article 74 generally requires an imposed sentence of no more than two years’ imprisonment, short-term detention or a fine, together with the applicable criminal-history and suitability conditions. Treatment obligations may be attached. law.moj.gov.tw

Neither attending treatment nor receiving a short sentence guarantees either outcome.

7. What Should You Do After a Police or Prosecutor’s Notice?

If you are receiving methadone treatment and become subject to investigation:

  1. Identify your procedural status. Check whether you are being contacted as a witness, suspect or defendant, and confirm the alleged offence.

  2. Obtain treatment records. Collect prescriptions, appointment records, medication-administration records and treatment certificates.

  3. Prepare an accurate timeline. Match treatment dates and administration times with the alleged conduct and sample collection.

  4. Preserve relevant records. Keep complete messages and documents concerning the medication’s source.

  5. Avoid coordinating accounts with others. Do not ask another person to change their account or agree on a shared explanation.

  6. Seek legal advice before questioning. Discuss the evidence, your procedural rights and whether legal accompaniment is appropriate.

A proper review may address the medication’s source, treatment authorisation, search and sampling procedures, laboratory evidence and any independent evidence of possession or supply.

8. Frequently Asked Questions

▪️Is hospital-administered methadone illegal because it is a Category 2 narcotic?

No. Authorised medical treatment is permitted within Taiwan’s controlled-drug framework. The classification does not make compliant treatment a criminal offence.

▪️Will testing positive for methadone automatically lead to imprisonment?

No. A test identifies a substance; treatment records and other evidence help establish whether its use had a lawful medical basis. A separate allegation involving another drug must be assessed independently.

▪️Can I give my prescribed methadone to a family member?

Do not share it. Your treatment authorisation does not extend to another person, and transferring medication can create criminal and medical risks.

▪️Is possessing a small amount automatically legal?

No. The 20-gram pure-content threshold concerns aggravated possession. It is not a general exemption for smaller quantities.

▪️Can I avoid prosecution by starting treatment after arrest?

Not automatically. Treatment may be relevant, but the pre-discovery protection, deferred-prosecution rules and other statutory procedures each have their own requirements.

9. How Legal Consultant Can Help

Legal Consultant can help distinguish authorised treatment from allegations of illegal use, possession or supply by reviewing medical records, laboratory reports, questioning records and the wider evidence.

Where treatment-based procedures or sentencing relief may be available, the assessment should address eligibility, previous cases and the person’s ability to complete the proposed conditions.

Methadone has a legitimate medical role in Taiwan, alongside strict legal controls. If an investigation arises, establishing the source, treatment history and precise allegation is the starting point for an evidence-based response.
